Website, messaging & service terms

Terms of Service

These Terms govern use of Kiwi Cleaning Company's website, quote process, communications, and service relationship. A separate service agreement applies when a customer electronically approves an estimate; visiting this website alone does not authorize work or accept that service agreement.

Important distinction

Requesting a quote does not authorize work. Cleaning services are authorized only when the customer approves the applicable estimate and any required service agreement or statutory notice. Mandatory California or federal consumer rights always control over inconsistent contract language.

1. Website and quote-request terms

These Terms of Service ("Terms") apply to the website and online services operated by Kiwi Cleaning Company ("Kiwi," "we," "us," or "our"). By using the website, you agree to use it lawfully and in accordance with these Terms.

A quote request is a request for information and does not create a contract for cleaning services, reserve a service date, or obligate Kiwi to perform work. Any estimate is subject to the scope, price, availability, site conditions, and terms shown in the estimate and any applicable service agreement.

You agree that information you submit is accurate to the best of your knowledge and that you have authority to request services or information concerning the property identified in your request.

2. Email, telephone, and SMS communications

You may choose how you would like Kiwi to send a quote where our form offers that choice. Providing an email address or phone number authorizes Kiwi to respond through the method you request and to communicate as reasonably necessary about the quote or service relationship.

SMS program terms

If you select SMS and affirmatively agree to receive text messages, you consent to receive SMS messages from Kiwi Cleaning Company at the number you provide regarding your quote request and related service communications.

  • Program: Kiwi Cleaning Company quote and service communications.
  • Message frequency: varies based on your quote and service activity.
  • Rates: message and data rates may apply.
  • Opt out: reply STOP to stop receiving SMS messages from this program. We may send one final message confirming the opt-out.
  • Help: reply HELP or call 877-331-5494.
  • Consent: consent to receive SMS is not a condition of purchasing services; Email may be selected instead where offered.
  • Carrier responsibility: wireless carriers are not liable for delayed or undelivered messages.
  • Privacy: mobile numbers and SMS opt-in/consent data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Quote-request SMS consent is for quote and service-related communications. Kiwi will not treat that consent as permission for unrelated marketing unless you separately and expressly opt in to such marketing.

3. Payments and payment-card processing

Payment is due according to the terms stated in the applicable approved estimate, booking, service plan, or invoice. Kiwi does not store full credit-card or debit-card numbers or card security codes (CVV/CVC) on our website or business systems. Card payments, when available, are processed by a third-party payment processor.

Where an online booking form expressly offers a card-on-file option, you may authorize our payment processor to securely store the payment method for future charges connected to the service option shown on that booking form. Unless the booking page expressly states otherwise, submitting a card-on-file booking does not itself create a charge. For recurring Trash Bin Washing plans booked through the online card-on-file form, the card is charged only after each completed visit at the rate disclosed for the selected plan. No credit card surcharge is added to Monthly, Every Other Month, or Quarterly recurring-plan charges. For a Single Visit Trash Bin Washing booking, the card is charged only after that booked service is completed at the disclosed single-visit rate. A materially different or additional charge that was not selected or disclosed in the booking requires additional authorization where required.

For recurring Trash Bin Washing service purchases made through our online booking pages, you may cancel anytime. If cancellation occurs after the 1st visit, the cancellation fee for the selected plan will apply: $26 for Monthly, $21 for Every Other Month, and $16 for Quarterly. The applicable fee is disclosed on the selected plan's booking page before the booking is submitted. These recurring-plan purchase terms do not modify any separately approved estimate or estimate agreement.

You may revoke authorization for future card-on-file charges by contacting Kiwi before the next service, subject to payment for services already completed and any non-waivable legal obligations.

Any late fee, finance charge, collection charge, cancellation fee, rescheduling fee, trip fee, or other charge applies only when it is separately disclosed, authorized where required, and permitted by applicable law.

4. Acceptable website use

You may use this website for lawful personal or business purposes related to learning about Kiwi, requesting services, communicating with us, and accessing public information. You may not:

  • attempt to bypass website security, CAPTCHA, access controls, or rate limits;
  • submit false, fraudulent, abusive, unlawful, or intentionally misleading information;
  • introduce malware, automated attacks, scraping that materially burdens the site, or other harmful code;
  • impersonate another person or misrepresent your authority concerning a property or business; or
  • use the website in a way that violates applicable law or infringes another person's rights.

5. Website content and third-party services

Website descriptions, photos, service examples, availability statements, and general pricing information are provided for informational purposes and may change. The approved estimate controls the actual scope and price of a job.

The website may rely on or link to third-party services, such as payment processors, communications providers, mapping services, advertising measurement, or other websites. Kiwi is not responsible for a third party's independent terms, privacy practices, availability, or content, except to the extent applicable law imposes responsibility on Kiwi.

6. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and is incorporated into these Terms for website and communication purposes. Kiwi does not sell customer personal information and does not sell or share mobile numbers or SMS consent data for third-party marketing or promotional purposes.

7. California and other non-waivable rights

Nothing in these Terms waives, shortens, or replaces a consumer right, statutory notice, disclosure, cancellation right, warranty, remedy, or legal protection that cannot lawfully be waived. If a California or federal law requires a specific notice, cancellation form, contractor disclosure, payment rule, or other term for a particular transaction, that mandatory requirement controls.

8. Website availability and limitation

We use reasonable efforts to keep the website available and accurate, but we do not guarantee uninterrupted access or that every website statement will always be error-free or current. Website content is not a substitute for the written scope, price, or legally required terms in an approved estimate or service agreement.

To the maximum extent permitted by law, Kiwi is not liable for losses caused solely by temporary website unavailability, transmission failure, third-party platform failure, or misuse of the website by another person. Nothing in this section limits liability for negligence, gross negligence, willful misconduct, fraud, violation of law, or another liability that cannot legally be limited or waived.

9. Changes, governing law, and contact

We may update these website Terms from time to time. The current version will be posted at this URL with its effective date. Updates do not retroactively change an already approved estimate or service agreement unless both parties lawfully agree to the change or applicable law requires it.

These website Terms are governed by the laws of the State of California, without limiting any consumer protection that applies under federal, state, or local law.

California Service Authorization & Customer Agreement

The following service agreement applies when a customer electronically approves an estimate that incorporates or presents this agreement. It is not accepted merely by browsing the website or requesting a quote.

Important California consumer notice

By electronically approving an estimate, Customer authorizes Kiwi Cleaning Company ("Kiwi") to perform the services described in the estimate and agrees to the terms below.

This Agreement is intended to document authorization for the cleaning services shown in the estimate. It does not waive, shorten, or replace any right, notice, disclosure, or remedy that California or federal law requires.

If this transaction is subject to California home-improvement, home-solicitation, contractor, or similar consumer-protection laws, Kiwi will provide and comply with any additional contract terms, cancellation notice or form, contractor-license information, insurance disclosures, mechanics-lien warning, payment schedule, change-order language, or other disclosures that are legally required before work begins. Any mandatory statutory notice or right controls over inconsistent language in this Agreement.

1. Estimate, scope & price

Kiwi will perform only the services specifically described in the approved estimate at the price shown in that estimate, except for changes separately approved by Customer.

The estimate is based on the conditions reasonably visible or disclosed when the estimate is prepared. Unless the estimate expressly states otherwise, the quoted price includes the labor, ordinary equipment, and cleaning products needed for the listed scope. Kiwi will not add hidden fuel, supply, or service charges after approval.

2. Authority to authorize work

Customer represents that Customer is the property owner, tenant, property manager, or another person authorized by the property owner to approve the services and grant reasonable access to the property.

Customer is responsible for obtaining any permission required from an owner, landlord, homeowners association, property manager, or other person or entity before work begins.

3. Payment terms

Payment is due according to the payment terms stated in the approved estimate or invoice.

Any late fee, finance charge, or interest will apply only if it is separately disclosed in writing and is permitted by applicable law. Kiwi may suspend or decline additional services on a past-due account and may use lawful collection remedies. Collection costs, court costs, or attorney's fees are recoverable only when and to the extent permitted by applicable law or a separate enforceable written agreement.

4. Customer preparation & movable property

Before service, Customer is responsible for removing, relocating, covering, or securely protecting movable or fragile items located within or near the work area, including vehicles, furniture, decorations, toys, tools, electronics, grills, umbrellas, cushions, potted plants, artwork, signs, and personal belongings.

Customer should identify any item or surface requiring special care before work begins. Kiwi is not responsible for loss or damage caused by Customer's failure to disclose, remove, protect, or secure such property, except to the extent loss or damage is caused by Kiwi's negligence, willful misconduct, violation of law, or another liability that cannot legally be waived.

5. Windows, doors & water intrusion

Before exterior cleaning begins, Customer is responsible for ensuring that windows, doors, skylights, vents, and other openings are properly closed and reasonably weather-tight.

Exterior cleaning may involve water, cleaning solutions, hoses, and pressurized or low-pressure equipment. Kiwi is not responsible for water intrusion caused by a pre-existing defect or condition such as failed seals, deteriorated caulking or weather stripping, improperly installed windows or doors, damaged roofing or siding, cracks, openings, or other conditions that were not reasonably weather-tight before service, except to the extent Kiwi's negligence or misconduct independently causes or worsens the damage.

6. Pre-existing, deteriorated & hidden conditions

Pressure washing, soft washing, window cleaning, roof cleaning, gutter cleaning, solar-panel cleaning, and other exterior services may expose or affect deterioration that existed before cleaning.

Examples include loose, peeling, oxidized, chalking, or failing paint or coatings; oxidized siding; cracked concrete, stucco, masonry, grout, or mortar; deteriorated wood; damaged roofing; brittle screens; failed window seals; defective caulking; loose fixtures; damaged electrical components; existing leaks; unstable materials; improperly applied coatings; and surfaces that cannot reasonably withstand normal cleaning procedures.

Customer agrees to disclose known leaks, delicate or damaged surfaces, recently painted or sealed surfaces, electrical hazards, unstable materials, and other conditions requiring special treatment before work begins.

7. Cleaning results & satisfaction promise

Kiwi will use reasonable professional care and methods appropriate to the service and visible condition of the property. Cleaning results depend on the age, material, condition, maintenance history, and type and severity of staining or contamination.

Complete removal of every stain, discoloration, odor, deposit, or contaminant cannot be guaranteed. Permanent staining, oxidation, rust, efflorescence, mineral or hard-water deposits, paint deterioration, etching, biological staining, and deeply embedded contamination may remain after cleaning. Unless expressly stated in writing, Kiwi does not promise that a surface will be restored to a new, original, or perfectly uniform appearance.

If Customer is not reasonably satisfied that the approved cleaning scope was performed, Customer should contact Kiwi promptly. Kiwi will have a reasonable opportunity to inspect the concern and, when the issue can reasonably be corrected by repeating or touching up the approved cleaning service, Kiwi will return and re-perform the affected cleaning at no additional labor charge. This promise does not require Kiwi to repair pre-existing defects or achieve a result that the surface condition makes unsafe or reasonably impossible.

8. Plants, landscaping & cleaning solutions

Kiwi will use reasonable care around landscaping and will use cleaning products and methods appropriate for the service. Customer is responsible for identifying especially delicate, valuable, newly planted, diseased, or unusually chemical-sensitive vegetation near the work area before service.

Kiwi is not responsible for damage caused solely by a pre-existing plant condition, inadequate irrigation, extreme weather, unusual sensitivity that was not disclosed, or another condition outside Kiwi's reasonable control, except to the extent Kiwi's negligence or misconduct contributes to the damage.

9. Pets, children, occupants & work-area safety

Customer is responsible for keeping children, pets, occupants, visitors, and other persons safely away from active work areas, hoses, ladders, equipment, cleaning solutions, and wet or slippery surfaces while service is being performed.

Kiwi may stop or postpone work if a person, animal, property condition, utility condition, or other hazard makes continued work unsafe.

10. Access, water & electricity

Customer authorizes Kiwi and its personnel to enter areas of the property reasonably necessary to perform the approved services.

Unless the estimate states otherwise, Customer authorizes Kiwi to use reasonable amounts of available exterior water and electricity at the service property as necessary to perform the approved work.

Customer is responsible for providing reasonable access to gates, driveways, work areas, exterior faucets, water sources, and electrical outlets that are needed for the service. If safe or reasonable access is unavailable, service may be postponed or rescheduled.

11. Weather, site conditions & rescheduling

Exterior cleaning is affected by weather, site conditions, water availability, equipment conditions, and safe working conditions. Kiwi may postpone, interrupt, or reschedule service when it reasonably determines that rain, wind, lightning, excessive heat, freezing conditions, unsafe surfaces, water restrictions, equipment problems, blocked access, or another condition makes performance unsafe, impractical, unlawful, or likely to cause property damage.

A reasonable safety- or weather-related delay is not a breach of this Agreement. Kiwi will make reasonable efforts to reschedule the affected work.

12. Changes, extra work & price changes

A material change to the approved scope or price requires Customer's prior written or electronic authorization before the changed or additional work is performed.

Any approved change should identify the added or removed work and the associated price change. Customer is not responsible for unauthorized additional work. If immediate action is reasonably necessary to stop an unsafe condition or prevent additional property damage and Customer cannot reasonably be contacted, Kiwi may take reasonable temporary protective action, but will not charge for additional corrective work without Customer authorization unless applicable law permits otherwise.

13. Subcontractors

Unless the estimate or a separate written disclosure states otherwise, the approved services are intended to be performed by Kiwi personnel rather than subcontractors. If a subcontractor will be used, Kiwi will disclose that before the subcontractor begins work and will provide any subcontractor information required by applicable California law.

14. Cancellation & customer rescheduling

Any cancellation, rescheduling, trip, or access fee must be clearly disclosed to Customer before approval or scheduling in order to apply.

Nothing in this Agreement limits any statutory right to cancel or rescind a transaction under California or federal law. If Customer receives a legally required Notice of Cancellation or other statutory cancellation notice, that notice controls and Customer may use the method and time period stated in that notice.

15. Photographs & service documentation

Customer authorizes Kiwi to photograph or video work areas before, during, and after service for property-condition documentation, quality control, proof of work, training related to the specific job, and resolution of service or damage concerns.

Kiwi will not use photos or video that identify Customer, occupants, or the service property for advertising or public promotional use without separate permission when permission is required by law or when a reasonable person would expect the material to remain private.

16. Service-specific limitations

Window cleaning is a cleaning service and does not repair failed seals, scratched glass, damaged screens, defective frames, leaks, or glass defects unless repair work is separately described in writing.

Gutter and roof cleaning remove accessible debris or contamination within the approved scope and do not constitute roofing, structural, waterproofing, or leak-repair work unless such work is separately and lawfully contracted.

Solar-panel cleaning is intended to remove accessible surface soil and residue. Kiwi does not guarantee a particular energy-production increase, electrical output, system efficiency, or repair of any panel, wiring, inverter, mounting, or electrical defect.

17. Damage or service concerns & opportunity to inspect

Customer agrees to notify Kiwi as soon as reasonably practical after discovering an alleged service problem or property damage believed to have resulted from the work so Kiwi has a reasonable opportunity to inspect the condition and attempt to resolve the concern.

When reasonably possible, Customer will allow Kiwi to inspect the condition before permanent repairs or alterations are made by another person. This does not prevent Customer from taking reasonable emergency action necessary to protect persons or property and does not waive any non-waivable legal right or remedy.

18. No waiver of non-waivable liability or consumer rights

Nothing in this Agreement releases or excuses Kiwi from liability to the extent caused by Kiwi's negligence, gross negligence, willful misconduct, fraud, violation of law, or any other liability that cannot lawfully be limited or waived.

Nothing in this Agreement requires Customer to waive a consumer-protection right, statutory remedy, cancellation right, or legal protection that cannot lawfully be waived.

19. Electronic transactions, signature & records

Customer agrees to conduct this approval transaction electronically. Customer understands that the estimate and this Agreement are electronic records and that Customer may save, print, or otherwise retain them for Customer's records.

Customer's act of checking the acceptance box, typing Customer's name, and selecting "Approve Estimate & Accept Agreement" is intended to constitute Customer's electronic signature and authorization for this transaction.

Customer may request a paper copy and may decline to conduct future transactions electronically without affecting the validity of a transaction already completed electronically, subject to any separate statutory requirements that apply to a particular transaction.

20. Entire agreement & order of precedence

The approved estimate, its scope and price, this Customer Agreement, any mandatory statutory notices or attachments, and any subsequently approved written or electronic change orders constitute the agreement concerning the approved services.

A mandatory statutory notice or disclosure controls over any inconsistent provision of this Agreement. A later written or electronic change order signed or approved by both parties controls only as to the specific change it describes.

21. Governing law

This Agreement is governed by the laws of the State of California, without limiting any consumer right or remedy that applies under federal, state, or local law.

22. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, that provision will be enforced only to the maximum extent permitted by law and the remaining provisions will remain in effect, unless applicable law requires a different result.

23. Electronic approval & acceptance

By selecting the acceptance checkbox and clicking "Approve Estimate & Accept Agreement", Customer confirms that Customer:

  • reviewed the project address, scope of work, scheduled service date, and price shown in the estimate;
  • reviewed this Agreement and had an opportunity to read it before approving;
  • has authority to authorize the work at the service property;
  • agrees to conduct this approval transaction electronically;
  • authorizes Kiwi to perform the services described in the approved estimate; and
  • intends the electronic approval to constitute Customer's electronic signature and agreement.

Customer should save or print a copy of the approved estimate and this Agreement for Customer's records.
